1. Introduction and Acceptance

Welcome to FutureMe by Hope Street ("FutureMe," "we," "us," or "our"), operated by Hope Street Group. These Terms of Service ("Terms") govern your access to and use of the FutureMe platform, including our website at www.hopestreetgroup.org and all related services (collectively, the "Services").

By using the Services, you accept and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

2.1 Age Requirement. You must be at least 13 years old to create an account and use the Services. By using the Services, you represent and warrant that you are at least 13 years of age.

2.2 Teacher and School Use. Teachers and educational institutions may facilitate student access to the Services. Students may use the Services either through direct self-registration or through teacher-facilitated access in a classroom setting.

3. Account Creation and Access

3.1 Account Registration. To access certain features of the Services, you may create an account by providing your name, email address, or phone number. You may log in using either:

• A magic link sent to your email, or
• An SMS code sent to your phone number

3.2 Login-Free Access. You may also use certain features of the Services without creating an account. However, without an account, you will not be able to save your conversation history or access personalized insights.

3.3 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you become aware of any unauthorized use of your account, we encourage you to contact us at outreach@hopestreetgroup.org.

4. Permitted Use

4.1 Purpose of Services. The Services are designed for career exploration, career guidance, and general future readiness. You may use the Services to:

• Engage in conversations with AI-powered career professionals
• Explore various career paths and educational opportunities
• Receive personalized recommendations related to your career interests
• Learn about colleges, activities, and resources related to career development

4.2 Personal and Educational Use Only. The Services are provided for your personal, non-commercial use and for educational purposes in school and classroom settings. You may not use the Services for any other purpose without our prior written consent.

5. Prohibited Conduct

You agree not to:

5.1 Use the Services in any way that violates any applicable federal, state, local, or international law or regulation

5.2 Attempt to circumvent, disable, or interfere with security-related features of the Services or features that prevent or restrict use or copying of any content

5.3 Engage in any conduct that is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable

5.4 Attempt to "jailbreak" or manipulate the AI in ways that are inconsistent with the intended use of the Services

5.5 Use the Services to engage in inappropriate conversations, including but not limited to conversations of a sexual, violent, or otherwise harmful nature

5.6 Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity

5.7 Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Services

5.8 Attempt to gain unauthorized access to any portion of the Services, other users' accounts, or any systems or networks connected to the Services

5.9 Upload, transmit, or distribute any viruses, malware, or other malicious code

5.10 Remove, circumvent, disable, damage, or otherwise interfere with any security-related features of the Services

6. Data Collection and Privacy

6.1 Data Collection. We collect and maintain records of your conversations with AI career professionals, along with your name, email address, or phone number when you use a logged-in service. This data helps us improve the Services and provide insights to educators about student career interests.

6.2 Privacy Policy. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, available at https://www.hopestreetgroup.org/privacy-policy

By using the Services, you consent to our data practices as described in the Privacy Policy.

6.3 Educator Insights. If you are a student using the Services through your school or teacher, we may provide your teacher or school with general insights about your career interests and conversation topics to help them better support your learning and development. These insights are designed to be educational and supportive in nature. 

6.4 No Sale of Data. We will never sell your personal information or student data to third parties.

7. AI-Generated Content and Disclaimers

7.1 AI-Powered Conversations. The Services use artificial intelligence to simulate conversations with career professionals and to provide career guidance and recommendations. AI-generated responses are provided for informational and educational purposes only.

7.2 No Professional Advice. The career guidance, college recommendations, and other information provided through the Services do not constitute professional career counseling, educational advising, or any other form of professional advice. You should not rely solely on AI-generated content for important life decisions.

7.3 No Guarantee of Accuracy. While we implement safeguards to ensure the quality and accuracy of AI-generated content, we cannot guarantee that all information provided through the Services is complete, accurate, current, or applicable to your specific situation. You are encouraged to verify important information independently.

7.4 Not a Substitute for Human Guidance. The Services are designed to supplement, not replace, guidance from parents, teachers, school counselors, and other trusted adults in your life.

8. Intellectual Property

8.1 Your Content. You retain all ownership rights to the messages, questions, and other content you submit to the AI through the Services ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive, royalty-free license to process and use Your Content solely to provide the Services to you and to improve the Services.

8.2 AI-Generated Responses. AI-generated responses are provided for your personal use in career exploration and educational purposes. You may use, share, and reference AI-generated responses as you see fit for your personal and educational needs.

8.3 Our Intellectual Property. The Services, including all software, text, images, graphics, user interfaces, visual interfaces, trademarks, logos, and other content (excluding Your Content), are owned by Hope Street Group or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8.4 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal and educational use.

8.5 Restrictions. You may not:

• Copy, modify, distribute, sell, or lease any part of the Services
• Reverse engineer or attempt to extract the source code of the Services
• Use the Services to create a competing product or service
• Remove or modify any proprietary notices from the Services

9. Service Availability and Modifications

9.1 Right to Modify or Discontinue. We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice, for any reason. We may add or remove features, change how the Services function, or make other updates as we deem necessary.

9.2 No Liability. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

9.3 Data Upon Discontinuation. If we discontinue the Services, we will provide reasonable notice and will delete student data in accordance with applicable laws and our data retention policies.

10. Data Retention and Deletion

10.1 Retention Policy. We retain your personal information and conversation data only as long as necessary to provide the Services and to meet applicable legal, contractual, or legitimate educational requirements.

10.2 Deletion Requests. Students aged 18 or older, parents or legal guardians of students under 18, or educational institutions may request deletion of student data at any time by contacting us at outreach@hopestreetgroup.org. We will process deletion requests within 30 days, except where retention is required by law or necessary to comply with legal obligations.

11. Termination

11.1 Termination by You. You may stop using the Services at any time. If you have an account, you may request account deletion by contacting us at outreach@hopestreetgroup.org.

11.2 Termination by Us. We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in conduct that is harmful to other users or to us.

11.3 Effect of Termination. Upon termination, your right to use the Services will immediately cease. We may, but are not obligated to, delete your account and any associated data. Sections 7, 8, 12, 13, 14, and 15 of these Terms will survive any termination.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

12.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12.2 WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

12.3 WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICES, INCLUDING AI-GENERATED CAREER GUIDANCE.

12.4 ANY CONTENT OR ADVICE OBTAINED THROUGH THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY RESULTING CONSEQUENCES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

13.1 IN NO EVENT SHALL HOPE STREET GROUP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

13.2 OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED FIFTY DOLLARS ($50).

13.3 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless Hope Street Group and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

14.1 Your use of or inability to use the Services

14.2 Your violation of these Terms

14.3 Your violation of any third-party rights, including intellectual property rights or privacy rights

14.4 Any content you submit through the Services

15. Dispute Resolution and Governing Law

15.1 Governing Law. All claims and disputes arising from the use of the Services are governed exclusively by the laws of Illinois, without regard to conflicts of laws principles. You agree and hereby submit to the exclusive personal jurisdiction and venue of the courts located in Illinois for the resolution of any lawsuit or court proceeding permitted under these Terms.

15.2 Informal Resolution. Before filing any legal claim, you agree to first attempt to resolve the dispute informally by contacting us at outreach@hopestreetgroup.org and providing a description of the dispute. We will attempt to resolve the matter within 30 days.

16. General Provisions

16.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hope Street Group regarding the Services and supersede all prior agreements, understandings, and communications.

16.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment. You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

16.5 No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights.

16.6 Changes to Terms. We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if you have provided one) or by posting a notice on the Services at least 30 days before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
